Terms and conditions
Please read these Terms and conditions carefully before using our services.
01. Interpretation and definitions
1.1 Interpretation. Capitalised terms have the meaning given in this section, whether used in the singular or the plural.
1.2 Definitions.
- Company (“we”, “us”, “our”): TECHINS DIGITAL SRL, registered in Cluj-Napoca, Cluj County, Romania, Tax ID 54339260, which provides the ArgonStack platform in Romania.
- Service: the website, the ArgonStack platform and all related features.
- Website: the ArgonStack website for Romania on which these Terms are published.
- User / Client: any natural or legal person who accesses or uses the Service.
- Terms: these Terms and conditions, which form a binding contract between the Company and the User.
02. Acceptance of the terms
Your use of the Service is governed by these Terms and constitutes a legally binding agreement. By accessing, registering for or using the Service, you fully and unconditionally accept these Terms.
- If you do not agree, you may not use the Service.
- Only persons aged 18 or over may use the Service.
03. Data processing agreement (DPA)
The processing of personal data through the Service is governed by the Data processing agreement (DPA), which forms an integral and binding part of these Terms.
By creating an account, activating or using the Service, the User confirms that they have read, understood and accepted the DPA. Acceptance of the DPA is automatic and does not require a separate signature.
04. Account and responsibilities
Access to some features requires an account. The User is solely responsible for:
- Keeping their login details safe.
- Any action carried out through their account.
The Company may suspend or delete accounts that breach these Terms.
05. Client data and access restrictions
The Company acts as a SaaS provider and does not own the data entered by the Client. The Client always acts as the data controller.
Access restriction. The Company processes data solely on the Client’s documented instructions, for the operation, hosting, security, maintenance, troubleshooting, support and compliance of the Service.
We are not responsible for the content, accuracy, lawfulness or origin of data entered by the Client.
06. Payments and subscriptions
- Prices are stated in the currency of the accepted offer (RON or EUR), plus VAT where applicable.
- Payments are made in advance unless otherwise agreed in writing.
- Amounts paid are non-refundable except where required by law.
07. Intellectual property
The ArgonStack software, content, design and trademarks are protected by intellectual property rights. The User receives a limited, non-exclusive, non-transferable licence to use the Service solely for their business activity.
08. Infrastructure and third-party providers
The Service is provided through a combination of proprietary systems and third-party infrastructure. The Company is the Client’s sole contractual counterparty.
09. Limitation of liability
The Service is provided “as is” and “as available”, without warranties, to the extent permitted by law. The Company is not liable for loss of profit or data, downtime or technical errors. The Company’s total liability shall not exceed the amounts paid by the Client in the last twelve (12) months.
10. Governing law and changes
These Terms are governed by Romanian law. Any dispute will be settled by the competent courts at the Company’s registered office in Cluj-Napoca.
The Company may amend these Terms. For material changes, you will be notified at least 30 days in advance.
